Summary of the hearing at the Shenandoah Circuit Court March 6th, 2026
On Friday afternoon in the Shenandoah Circuit Court in Woodstock, Virginia Judge Black presided over a hearing of two motions submitted by the city of Richmond in response to our lawsuit contesting the disposal of the statues, monuments, plinths, and objects from Monument Avenue.
Richmond immediately withdrew their change of venue motion, leaving the case to be decided in the Shenandoah Circuit Court.
The focus of the hearing turned to the demurrer request from the city. Their attorney said that the monument acquisition was not a procurement action. Our attorney argued that city awarded the monuments to an entity which did not accept nor place a bid for them. Then a discussion on procurement services and if certain statutes applied to the transfers and whether the Dillon Rule was applicable to these transfers ensued. After listening to the attorneys at 3:04 pm Judge Black overruled the demurrer (a dismissal motion).
The Judge stated the intent of the 2020 Monuments law was not to give a monument to a museum so that they can be displayed at a sewage treatment plant. The Judge stated that he hates to decide cases where there is a solution and the Judge encouraged the parties to work on a settlement.
While we are cheered and encouraged by the Judge's decisions, we also still need help to pay for the dedicated and hard-working lawyers that got us to this point. And we are not sure how the cooperative the counter parties will be during negotiations.
